Questions and answers

What is a workplace investigation?

A workplace investigation is a fair, impartial process for establishing the facts when an employee raises a complaint or an allegation of misconduct is made. The investigator makes findings about whether each allegation is substantiated; the employer then decides what action to take.

Who does BION Partners work for?

Employers and organisations only, across all employment sectors. Individuals seeking advice on a workplace issue should contact the Fair Work Commission on 1300 799 675.

Where is BION Partners based?

Mackay, Queensland. We travel to Bowen Basin and regional sites, including Moranbah, Dysart, Middlemount, Clermont, Nebo and surrounds, and work with employers in regional Queensland and across Australia.

How are interviews conducted?

Interviews are one-on-one and conducted in person or by video call. Translation services can be provided on request.

What types of matters do you investigate?

Employee grievances, workplace bullying, conflicts of interest, corruption, fraud, inappropriate use of IT resources, misconduct, misuse of authority, misuse of social media, nepotism, negligence and insubordination, public interest disclosures (whistleblowing), sexual harassment, workplace theft and workplace violence.

What do you not do?

BION Partners does not provide services relating to workers compensation, does not conduct surveillance activities, and does not interview children.

When should we use an external investigator instead of investigating internally?

When allegations are serious or could lead to dismissal, involve senior people, involve HR or the person who would normally investigate, or when nobody internally is trained, independent and available. Read the full guide.

What is the BION Audit?

A comprehensive audit of your organisation’s internal investigation protocol, procedures, documentation and reporting, with a detailed report on vulnerabilities, areas for improvement and recommendations. More about the BION Audit.

Can we ask for a female investigator?

Yes. BION Partners has experienced female investigators on the team for circumstances where a female investigator is considered more appropriate.

Do you provide interpreters?

Translation services during the course of an investigation can be provided on request.

Can you help us run our own investigation?

Yes. Partner with us to conduct your own workplace investigation. We advise your team so your organisation conducts investigations at acceptable levels of procedural fairness.

What standard of proof applies in a workplace investigation?

The balance of probabilities: whether it is more likely than not that the conduct occurred. The more serious the allegation, the stronger the evidence needs to be (the Briginshaw principle).

How long does an investigation take?

It depends on the size and complexity of the matter. Many investigations are completed within about a week; larger or more complex matters take longer, and we’ll give you a timeframe at the start. What affects timeframes.

Do participants have to agree to be interviewed?

Every participant is asked for, and gives, written consent before their interview, covering the interview and how their information will be used in the report to the employer.

Do you use AI in investigations?

We use secure AI tools to help with administrative tasks such as transcription and organising evidence. Every finding is made and reviewed by the investigator, not by AI, and confidentiality is maintained throughout.

How much does it cost?

An investigation package can be tailored to suit individual circumstances and budget. The initial consultation is free.

Do you deal with unions?

Yes. We are experienced in liaising with unions involved in representing parties to a complaint.

No. It is general information only. For advice on your situation, speak with a lawyer.
